Media Liability Insurance

Protect your business against claims from content creation and publishing.

What Is Media Liability Insurance?

Quick Summary

Media liability insurance protects your business if someone claims your content has harmed them. That includes a social post that damages a person's reputation, a campaign that uses an image you didn't have the rights to, or an ad that copies a competitor's slogan.

These claims can arrive as a letter of demand, a takedown notice or a court filing, and the legal costs alone can run into tens of thousands of dollars before the matter is even resolved. Media liability cover pays for your defence and any compensation you're ordered to pay, up to your policy limit.

Who Needs This?

You don't need to be a newspaper to publish content. If your business writes, designs, films, posts or broadcasts anything the public sees, you carry media risk.

How Media Liability Claims Happen

These examples are illustrative, but they reflect the types of claims we see across South East Queensland businesses.

A Fortitude Valley agency uses the wrong image. A designer pulls a photo from a Google search for a client's Facebook ad. Six months later, the photographer's lawyer sends a demand for licensing fees plus damages. The agency is liable because it supplied the creative.

A Brisbane podcaster criticises a local business. An episode makes claims about a restaurant owner's conduct that can't be backed up. The owner commences defamation proceedings, arguing the episode caused serious harm to their reputation.

A social media manager doesn't moderate comments. Customers post defamatory comments about a former employee on a business page the agency manages. In Australia, the page operator can be treated as the publisher of third-party comments, following the High Court's 2021 decision in Fairfax Media v Voller.

An influencer's review goes too far. A creator reviews a skincare brand's product and makes claims about its ingredients that turn out to be wrong. The brand alleges injurious falsehood and seeks compensation for lost sales.

Frequently Asked Questions

  • No, it isn't legally required. However, many clients, broadcasters and platforms require it under contract before you can start work.

  • It might. Some PI policies include limited media cover, while others exclude it entirely. We can review your current policy and tell you where the gaps are.

  • If you earn income from content, especially sponsored posts or reviews, you carry the same legal exposure as a larger publisher. A defamation or copyright claim can be just as costly for an individual.

  • Client approval doesn't automatically remove your liability. If you created or published the content, you can still be named in a claim. Media liability cover helps respond regardless of who signed off.

  • Most media liability policies are written on a claims made basis. Some can include retroactive cover for earlier work, provided you weren't aware of a potential claim. Ask us about retroactive dates when you get a quote.

  • Yes. Production companies often arrange project-specific cover, sometimes called errors and omissions insurance, to meet distributor or broadcaster requirements.
